New Hampshire Law on Spousal Support
Under New Hampshire law, courts will issue spousal support orders based on a party’s demonstrated need for financial support after a divorce, and the other party’s ability to pay for their former spouse’s financial support. Spousal support orders can be either temporary or permanent depending on a variety of factors that New Hampshire courts must evaluate.
Under New Hampshire law, courts consider the following factors when assessing the appropriateness of an alimony award:
- The length of the marriage
- The age and health of the parties
- The social or economic status, occupation, or financial condition of each party
- Each parties rights under a property settlement agreement
- The vocational skills, employability, assets, and liabilities of the parties
- The likelihood that each party will acquire capital assets and income
- The fault of either party
- Tax consequences of awarding spousal support
Courts may issue temporary spousal support awards pending their divorce trial in certain situations. These “interim” spousal support orders are designed to place the parties on more even grounds during divorce litigation where there is a disparity in financial resources and access to legal representation. Our attorneys can help you obtain temporary spousal support pending trial if the other party won’t provide you with enough money for your living expenses and legal fees.
