What Are Grounds for Divorce in New Hampshire?

Just like every other state, New Hampshire is a no-fault divorce state. This means that a couple does not have to prove a fault in the other spouse in order to file for divorce. The couple must simply state that there are “irreconcilable differences”, which have caused the marriage to breakdown beyond repair.

While a no-fault is the simplest and most common way to divorce, New Hampshire does have various options for a “fault” divorce. A spouse can also file for divorce based on the following grounds:

  • Impotence
  • Adultery
  • Criminal conviction
  • Negligent behavior that put the filing spouse’s health at risk
  • Abandonment without contact for two years or more
  • Alcohol or drug abuse for two years or more
  • When one spouse joins a religious sect that prohibits relations between the husband and wife and leads that spouse to separate for six months or longer

What Are New Hampshire's Divorce Residency Requirements?

The residency requirements for filing for divorce in New Hampshire are one of the following:

  • Both spouses are residents in New Hampshire and the filing spouse has been a resident for at least one year before filing for divorce, OR;
  • The grounds for divorce occurred in the state and one of the spouses has been a resident for at least one year

Is NH A No-Fault State For Divorce?

Yes, New Hampshire is a no-fault state for divorce. This means that you do not have to prove that your spouse did anything wrong to get a divorce. Instead, all you need to do is show that the marriage is irretrievably broken. For example, this can be done by showing that you and your spouse have lived apart for at least 12 months or that you and your spouse have been unable to live together as husband and wife for at least 12 months because of discord or conflict between you.
